No Trial For KSM…Anywhere?

I thought that holding prisoners without trial indefinitely was a bad thing? At least it was when the Bush administration was doing it.

The accused mastermind of the Sept. 11, 2001, terror attacks,Khalid Sheikh Mohammed, may remain behind bars without trial indefinitely because of disagreement over his trial location, according to the Washington Post.

The Obama administration has concluded it can’t go ahead with its original plan to have the trial in federal court in New York because of opposition from lawmakers and local officials, the Post said. There is little support for reviving an effort to hold a military trial at Guantanamo Bay, according to the Post.

Obama administration officials said Mohammed and four alleged co-conspirators can be held under laws of war, until a trial location is agreed on, the newspaper reported.

This is a disgrace.  The Obama administration created the dispute over whether or not Khalid Sheikh Mohammed should be tried in New York City or in a military tribunal setting (tribunals having been the traditional venue for cases for suspected terrorists).  And now that their preferred venue is unpopular their solution is….to do nothing?

This (KSM) is a man who may have coordinated the plan to murder nearly 3,000 Americans.  It appears that by refusing to move this trial back to a military tribunal the President is afraid to upset the civil liberties wing of his party (or he is just afraid to admit his administration was wrong).  This is not an issue that can be punted.  The administration needs to place this trial in the hands of a military tribunal court.

    I don’t understand why there isn’t more support for returning to a military tribunal. I don’t understand why Congress can’t pass a bill that would allow for a special tribunal so there could be additional observers to ensure the tribunals are fair and at least somewhat open to the public and yet protects national security issues too.

    I can’t imagine any other community would be willing to host KSM’s civilian trial if NYC isn’t willing to host it themselves. I wouldn’t want him here in Minneapolis – it would create a terror threat to any city that hosted him. But a military base where he faced a military tribunal – they would be better prepared to deal with any threats.

    Makes me wonder if it’s an anti-military bias on the part of the administration. I never understood why they stopped the tribunals to push for a civilian trial. If they’d left the tribunals alone, KSM would be convicted by now – THEN we could leave him in a cell to rot forever. But leaving him to rot without a trial isn’t the answer.
